Terms of Service
Please read these terms carefully before using Travely.
1. Acceptance of Terms
By accessing or using Travely, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our application.
Travely reserves the right to update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of material changes via email or in-app notification.
2. Description of Service
Travely is an AI-powered travel planning application that helps users discover, plan, and navigate trips. The service uses artificial intelligence to generate itineraries, place histories, local curiosities, and visit guidelines. Audio narrations are generated using AI-powered text-to-speech technology. Content is available in 12 languages.
3. User Accounts & Subscriptions
You must create an account to use Travely. You may register with email and password or sign in using Google or Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Responsibility
You must provide accurate information and keep your account secure. Notify us immediately of any unauthorized use. New accounts require email verification before full access is granted.
Account Deactivation
Accounts may be deactivated by an administrator. Deactivated accounts cannot access the service until reactivated. You may also request full account deletion by contacting us.
Termination
We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting us.
4. Subscriptions & Billing
Free Plan
You may use Travely at no cost with up to 10 places per route. The Free plan includes AI itinerary curation, full place stories, and navigation assistance.
Traveler Pass ($19.99/year)
The Traveler Pass unlocks: up to 20 places per route, local secrets, AI audio narration, visiting guidelines, and dine break suggestions. The Traveler Pass is billed annually at $19.99 USD (or local equivalent) and automatically renews at the end of each billing period.
Payment Processing
All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method. Your billing information is subject to Stripe's terms of service and privacy policy.
Cancellation
You may cancel your subscription at any time through the billing portal accessible from Settings. Cancellation takes effect at the end of your current billing period — you retain access to paid features until that date.
Refunds
Subscription fees are generally non-refundable. If you believe you have been charged in error, contact support within 14 days of the charge.
Plan Changes
If you cancel, your account is downgraded to the Free plan at the next billing date. Itineraries you have saved remain accessible, but premium features are restricted.
AI-Generated Content
Itineraries, place histories, local curiosities, visit guidelines, and audio narrations are generated by artificial intelligence using third-party AI providers. This content is for informational purposes only and is periodically refreshed. Always verify details independently before making travel decisions. AI-generated place suggestions presented during route curation are produced by artificial intelligence and may not reflect the most current information. Always verify opening hours, accessibility, and admission requirements independently before your visit.
5. Acceptable Use
You agree to use Travely only for lawful purposes and in accordance with these Terms. You must not:
- Use the service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the service or its systems
- Use automated systems (bots, scrapers) to access the service without permission
- Interfere with or disrupt the integrity or performance of the service
- Attempt to reverse-engineer, decompile, or extract source code from the application
- Circumvent rate limits or abuse API endpoints
We reserve the right to investigate and take appropriate action against any violations, including removing content and suspending or terminating accounts.
6. Rate Limiting & Fair Use
To ensure fair access for all users and protect against abuse, certain endpoints are subject to rate limiting. Excessive requests may be temporarily throttled or blocked. Rate limits vary by endpoint and subscription tier.
If you believe your legitimate usage is being restricted, please contact us and we will review your case.
7. Limitation of Liability
Travely is provided "as is" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content, including itineraries, place information, audio narrations, or recommendations.
To the maximum extent permitted by law, Travely shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our service, including but not limited to reliance on AI-generated travel recommendations.
Third-Party Services
Travely relies on third-party providers to deliver core functionality, including OpenAI (AI content generation), Google Maps (mapping and place data), Stripe (payment processing), RunPod (audio narration), and DigitalOcean (file storage). We are not responsible for service interruptions caused by these third parties. Use of these services is subject to their respective terms.
8. Intellectual Property
All content, features, and functionality of Travely — including design, code, text, graphics, and the Travely brand — are owned by Tiltely and protected by intellectual property laws.
You retain ownership of your travel data and itineraries. By using Travely, you grant us a limited license to process your data as described in our Privacy Policy.
9. Affiliate Links
We may include links to third-party booking services (such as tour operators or restaurants). Some of these links may be affiliate links, meaning Tiltely may earn a commission if you make a purchase through them. This does not affect the price you pay. We will clearly mark affiliate content when these features are active.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
Any disputes arising from these Terms or use of the service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of Italy.
